D8THC: A Milder Version Of Delta-9-THC?

Let us investigate how cannabinoids are synthesized in order to understand what Delta 8 THC is; Natural chemical reactions such as isomerization, oxidation, and decarboxylation cause cannabinoids such as CBD, Delta-8, and Delta-9 THC. Is Delta 8 THC Safe? What are the possible side effects?

Is Delta-8 thc legal?

While this information can not be used as legal advice, particularly given the ongoing changes in cannabis legislation, all hemp derivatives, isomers, and cannabinoids in Hemp Bill 2018 have become federally legal, provided that they contain less than 0,3 percent Delta-9-THC. This may mean that Delta-8-THC is legal as a cannabinoid, a hemp byproduct with less than o.3% Delta-9-THC.

There is not a simple response to this, unfortunately, particularly following the rule released by the drug enforcement authorities on delta-8 THC on 20 August. The law reiterates the stance of the DEA that any synthetically developed cannabinoid is illegal. As D-8 THC occurs naturally at low levels, it is usually produced using a chemical catalyst when CBD is converted into delta-8 THC. Although natural CBD occurs in hemp, the DEA considers that the resulting compound is synthesized and thus a narcotic in Schedule I, once the catalyst is added.

The wording “hemp” means the plant Cannabis sativa L is found in section 297A of the Farm Bill (or Agriculture Improvement Act 2018). And any portion of that herb, whether or not cultivating seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts, and isomer salts, with concentration not exceeding 0.3% on a dry basis in Delta9.

Last Few Words

However, in addition to the initial 0,3 percent delta 9 THC restriction, the apparently “not revolutionary” DEA law introduces another major barrier for delta 8 THC. Considering that the DEA is considered to be illegal for the most common method of production of this type of hemp, the production and selling of delta 8 THC would probably be difficult in the immediate future. It can also differ from State to State for the legality of delta-8 THC. Finally, not all medication tests are different from delta-9 and delta-8 THC — because they are chemically closely related — so D-8 THC can cause someone to test for marijuana positive, even if they never have consumed delta-9 THC.
